Welcome to Play Privy! These Terms of Service ("Terms") govern your use of the Play Privy website, mobile application, and related services (collectively, the "Service") operated by Play Privy, Inc. ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

Play Privy is a golf booking platform that connects golfers with premium golf courses. Our Service allows you to:

• Browse and search golf courses
• Book tee times at participating courses
• Manage your golf reservations
• Access exclusive golf experiences
• Connect with other golfers

3. User Accounts

3.1 Account Creation

To use certain features of our Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion.

4. Booking Terms

4.1 Booking Process

When you book a tee time through our Service:

• You enter into a direct agreement with the golf course
• Payment is processed immediately upon confirmation
• You receive a booking confirmation via email
• You must arrive at the course with valid identification

4.2 Booking Modifications

Changes to bookings are subject to course availability and policies. Modification requests must be made through our platform or by contacting customer service.

4.3 No-Show Policy

Failure to arrive for your tee time without prior cancellation may result in forfeiture of payment and potential restrictions on future bookings.

5. Payment Terms

5.1 Pricing

All prices are displayed in US dollars and include applicable taxes unless otherwise stated. Course fees, cart fees, and any additional services are clearly itemized before payment.

5.2 Payment Processing

We use third-party payment processors to handle transactions securely. By providing payment information, you authorize us to charge the specified amount for your booking.

5.3 Booking Fees

Play Privy charges a small booking fee for our services, which is clearly displayed before you complete your reservation. This fee is non-refundable except as required by law.

6. Cancellation and Refund Policy

6.1 Standard Cancellation Policy

Cancellations made 24 or more hours before your tee time are eligible for a full refund. Cancellations made between 12-24 hours receive a 50% refund. Cancellations made less than 12 hours before your tee time are not eligible for a refund.

6.2 Weather-Related Cancellations

If a golf course officially closes due to weather conditions, you will receive a full refund. Decisions about course playability are made solely by course management.

6.3 Refund Processing

Approved refunds are processed within 5-7 business days to your original payment method. Booking fees may be non-refundable depending on the circumstances.

7. User Conduct

7.1 Acceptable Use

You agree to use our Service only for lawful purposes and in accordance with these Terms. You will not:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Transmit harmful or malicious content
• Attempt to gain unauthorized access to our systems
• Use the Service for commercial purposes without permission

7.2 Golf Course Etiquette

When playing at courses booked through our Service, you agree to:

• Follow all course rules and dress codes
• Maintain appropriate pace of play
• Respect other golfers and course staff
• Take care of course facilities and equipment

8. Intellectual Property

8.1 Our Content

The Service and its original content, features, and functionality are owned by Play Privy and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 User Content

You retain ownership of content you submit to our Service. However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute such content in connection with our Service.

9. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our Service. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy.

10. Third-Party Services

Our Service may contain links to third-party websites or services that are not owned or controlled by Play Privy. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

11. Disclaimers

11.1 Service Availability

We strive to maintain continuous service availability but cannot guarantee uninterrupted access. The Service is provided "as is" and "as available" without warranties of any kind.

11.2 Course Relationships

Play Privy acts as an intermediary between users and golf courses. We are not responsible for the quality of golf courses, their facilities, or services provided by course staff.

12. Limitation of Liability

To the maximum extent permitted by law, Play Privy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

13. Indemnification

You agree to defend, indemnify, and hold harmless Play Privy and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

15. Governing Law

These Terms shall be interpreted and governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved in the courts of San Francisco County, California.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
